1. Intellectual Property Rights

1.1. Submitted photos must be original, created and/or taken by the contestant. They must not contain any materials owned or controlled by a third party for which the contestant has not obtained a license, and must not infringe the copyright, trademark, moral rights, rights of privacy/publicity, or intellectual property rights of any person or entity.

1.2. Copyrights shall remain vested with the creator of the image. By making a submission, you grant CO2Art Technologies Limited a worldwide, non-exclusive, royalty-free, sub-licensable right and license to use, publish, reproduce, display, perform, adapt, create derivative works, distribute, print, in whole or in part, in any form, in all media forms now or hereafter known, to promote the competition, the submitted image, the photographer, or for editorial or educational use.

2. Liability

2.1. You hereby hold harmless, release, indemnify, and discharge CO2Art Technologies Limited and its partners, affiliates, subsidiaries, advertising agencies, agents, and their employees, officers, and representatives from all liability, claims, judgments, demands, controversies, agreements, damages, actions, and causes of actions whatsoever, arising out of or related in any way to the competition, the conduct of the competition, and the acceptance, use, misuse, or possession of any prize awarded, whether in law or in equity, regardless of the cause or nature. You further waive any claims that you may state or assert against CO2Art Technologies Limited in association with the competition or any of its associated activities, or in any way related to or resulting from the competition, even if such injury or claims result from or are caused by the negligence or gross negligence of CO2Art Technologies Limited, in whole or in part, due to human error or otherwise. You further agree to indemnify and hold harmless CO2Art Technologies Limited from any claim arising out of your participation in the competition, including, without limitation, all claims brought or asserted by any third party as a result of any injury or loss that you or they may sustain in any way associated with your participation in the competition.

2.2. Under no circumstances will CO2Art Technologies Limited be liable for: a) Lost, late, misdirected, stolen, illegible, or incomplete submissions. b) Error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to, or alteration of, submitted photos. c) Problems, failures, or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players, or browsers, on account of technical problems or traffic congestion on the internet, at any website, or on account of any combination of the foregoing. d) Incorrect or inaccurate information, caused by any of the equipment or programming associated with or utilized in the competition or by any technical or human error which may occur in the processing of the photos and/or the submissions. e) Injury or damage to any participant or to any computer related to, resulting from, or in connection with the competition.

3. Disclaimer of Liability

3.1. Disclaimer: This contest and its activities are entirely independent and not sponsored, endorsed, or administrated by, or linked to, the Facebook/Instagram service.

4. Additional Provisions: Contest Rules

4.1. To participate in the contest, you must meet the following conditions: A. Familiarize yourself with the content of the Contest Regulations. B. Send a photo of your aquarium along with an original title and description via the application form available on the CO2Art.com/awards competition website.

4.2. Fulfillment of the conditions specified in paragraph 1 points A/B of this paragraph constitutes a submission (hereinafter referred to as the “Contest Submission”).

4.3. From the submitted applications, the judging panel will select the top three, which will be awarded.

4.4. Prizes in the contest and how they are awarded: Within 2 weeks of the end of the contest, the Competition Commission appointed by the Organizer and consisting of representatives of the Organizer (hereinafter referred to as the “Competition Commission”) will select three people whose photos were the most liked based on the subjective criterion of creativity (hereinafter referred to as the “Winners”). The winners of the contest will receive:
1st place: a cash prize of $300,  a set of trimming tools and a CO2Art T-shirt
2nd place: a cash prize of $200,  a set of trimming tools and a CO2Art T-shirt
3rd place: a cash prize of $100,  a set of trimming tools and a CO2Art T-shirt

4.5. The tasks of the Competition Commission include selecting the winners of the contest, as well as determining the validity of the contest results and ensuring the process of obtaining the necessary data to award the prizes to the winners and the timing of their delivery. The tasks of the Competition Commission specified in this paragraph will be performed in accordance with the provisions of these Contest Regulations and the principles of complete fairness of the conducted activities.

4.6. In the competition, three prizes are awarded for the first, second, and third place.

4.7. Personal data will be processed solely for purposes materially related to the contest, i.e., for the purpose of selecting the winners of the contest, for purposes related to the implementation of the contest and the award of prizes, and for posting a list of contest winners (names, surnames) in a post on the brand’s official fan page and PR/Marketing collateral in awareness of the competition.

4.8. Providing personal data is voluntary but necessary for the implementation of awarding prizes and consideration of any complaints. People providing personal data have the right to: access data, the possibility of correcting them, request deletion of data, and cessation of their processing.

5. Announcement of Results and Prizes

5.1. The contest winners will be notified of the award by announcing the results in a separate post published on social media channels (Facebook and Instagram) within 2 weeks after the end of the contest.

5.2. Awarded contest participants are obliged to provide their personal data necessary for the award of the prize, i.e., name, surname, street, house/flat number, postcode, city, phone number, no later than within 14 working days from the moment of announcing the contest results. The contest participant, notified of the win, should send shipping data for the prize via private message on Facebook or Instagram directed to CO2Art_US.

5.3. The Organizer will issue physical prizes to the winners of the contest via a courier company within 14 working days from the moment of announcing the contest results and receiving the personal data necessary for the award of the prize.

5.4. The contest participant is obliged to immediately notify the Organizer of the change of address or other data previously provided for the purpose of awarding the prize.

5.5. In the event of a lack of contact with the awarded participant within 14 working days from the moment of informing about the award and the lack of providing shipping data for the prize, the right to the prize passes to the Organizer.

5.6. The awarded participant does not have the right to reserve special features of the prize or to receive its equivalent (cash, in-kind).
